Terms of Service

Agreement

These terms are an agreement between you and R.A.D.D. LLC (“RADD,” “we,” “us,” or “our”), which operates RADD Fitness at 74 Cedar Swamp Road, Glen Cove, New York. They cover our website (raddfitness.com), our member and coaching app, our classes and personal training, and the use of our facility. By buying a membership, booking a class or session, or using the app, you agree to these terms. If you do not agree, please do not use the services.

These terms sit alongside two other documents: our privacy policy and the liability waiver and release you sign before training. The waiver is a separate agreement and nothing here replaces, limits, or overrides it.

Membership and payment

Membership terms — what you get, what it costs, and how often you are billed — are what we agreed with you at sign-up and what your membership record shows in the app. We do not change your rate without telling you first.

Recurring memberships are billed by card through Stripe, our payment processor. Monthly memberships bill on the 1st of the month. We never see or store your full card number; Stripe holds it. You are responsible for keeping a working card on file, which you can update yourself from your account in the app.

Session packages (personal-training packs and class packs) are a fixed number of sessions and may carry an expiry date, both shown on your membership record. Unused sessions do not roll over past an expiry unless we agree otherwise in writing. Drop-in visits are paid at the time of the visit.

If a payment fails we will try to reach you and may pause access until it is resolved.

Changing, pausing, or cancelling

To cancel, change, or pause your membership, contact us at info@raddcrossfitnsli.com or speak to us at the gym. The app lets you update your card, but cancellations and holds go through us so that a person confirms your final billing date with you and nothing is cancelled by accident. We will confirm any change in writing.

We may end or suspend a membership — with a refund of any unused prepaid time where it is fair to do so — for non-payment, or for conduct that puts other members, our staff, or the facility at risk.

Classes, booking, and the facility

Classes are booked through the app and have limited capacity. Please cancel a reservation you cannot use so the spot goes to someone else. We may change, combine, or cancel classes — for holidays, weather, coach availability, or low attendance — and we will post changes in the app.

While you are in the building, follow the coaching staff’s instructions, use the equipment as intended, and re-rack and clean what you use. Access to the gym is personal to you: do not share your door access, app account, or key tag with anyone else.

Health, safety, and assumption of risk

Exercise carries risk of injury. You should talk to a physician before starting any training program, and you agree that you are in adequate health to take part. Tell your coach about injuries, illnesses, medications, and pregnancy so we can program around them, and stop and tell a coach if something hurts.

Our coaches provide fitness coaching. Nothing we provide — programming, nutrition guidance, or advice in the app — is medical advice, diagnosis, or treatment, and it is not a substitute for care from a qualified professional. The separate waiver you sign covers assumption of risk and release of liability in full.

Members under 18

A member under 18 may train with us only with a parent or legal guardian’s consent. The guardian signs the waiver, agrees to these terms on the minor’s behalf, and is responsible for payment. We do not knowingly create accounts for children under 13.

Using the app

Your app account is for you alone. Keep your sign-in link and device secure, and tell us if you think someone else has access. You agree not to try to reach other members’ data, interfere with the app’s operation, scrape it, or use it to break the law.

The app has shared spaces — gym chat, leaderboards, workout results, and messages to your coach. What you post there should be something you are comfortable other members and our coaches seeing. Be civil: no harassment, abuse, or content that is unlawful or infringes someone else’s rights. We may remove content or close an account for conduct that breaks this. You keep ownership of what you post, and you give us permission to store and display it inside the app so the app can work.

Programming, workouts, written content, branding, and the app itself remain ours. Please do not redistribute our programming outside your own training.

Availability

We work to keep the gym and the app running, but we cannot promise either is available without interruption. Hours, schedules, and app features change, and we may need to close for holidays, maintenance, or events beyond our control.

Limitation of liability

To the fullest extent the law allows, and except where the separate waiver and release governs, RADD is not liable for indirect, incidental, or consequential damages arising from your use of the services, and our total liability for any claim relating to these terms is limited to the amount you paid us in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law.

Changes to these terms

We may update these terms. If a change is significant, we will tell members in the app or by email before it takes effect. The effective date at the top shows when this version took effect, and continuing to use the services after that means you accept the update.

Governing law

These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Nassau County, New York.
